SAS SA, operating under the brand SONOSAX, is the contractual partner for all purchases made via the website and webshop.

2. GENERAL TERMS

These General Terms and Conditions of Business apply to all purchases and the utilization of services through www.sonosax.ch, the online shop operated by SAS SA under the brand SONOSAX (hereinafter the “web pages” or “website”).

By placing an order via our web pages, you accept these General Terms and Conditions. Any differing or additional conditions of the customer apply only if they have been expressly accepted by SONOSAX in writing.

The special terms and conditions applying to the purchase of certain products or the utilization of certain services are further defined below.

The products and services offered online are only valid to the extent that they are visible on the web pages and for as long as stocks last. The images shown on the web pages are for illustration purposes only and are not binding. The information and explanations presented in catalogues and information sheets are solely for explanatory purposes and are not binding.

SONOSAX does not assume any responsibility for errors or imprecise information in the images, diagrams, explanations and similar content contained in said catalogues and information sheets.

3. PRICES, FEES AND TAXES (WEBSHOP)

All prices shown on the web pages are stated in Swiss francs (CHF). Where applicable (in particular for deliveries within Switzerland), prices include Swiss VAT and Swiss VAT is shown during checkout. For deliveries outside Switzerland, Swiss VAT is generally not charged; customers are responsible for any customs duties, import VAT, brokerage fees or other charges that may apply in the destination country. Shipping costs and any applicable fees are shown separately during the order process.

SONOSAX reserves the right to change prices at any time. However, for products already ordered, the prices valid on the date of the order and indicated in the order confirmation will apply.

  • PayPal (international sale fee 5%)
  • Credit / Debit card

Shipping:

We ship worldwide. Shipping charges (covering handling, shipping fees and administrative costs) may vary depending on the size and/or weight of the shipment. As a reference, typical shipping charges are as follows:

  • Within Switzerlan by regular post: CHF 20.–
  • Europe & North America: CHF 50.–
  • All other countries: CHF 80.–

Local pickup at the SONOSAX factory (Switzerland) is free of charge.

4. CONCLUSION OF CONTRACT

The presentation of products on the web pages does not constitute a legally binding offer, but an invitation to place an order. By completing the order process and clicking the “Order” / “Buy” button, you make a binding offer to purchase the selected products.

SONOSAX will confirm receipt of the order by e-mail (order confirmation). A binding purchase contract is concluded when the order confirmation is sent to you, or at the latest when the products are dispatched.

SONOSAX reserves the right to refuse orders or to cancel them in whole or in part, in particular in case of:

  • obvious errors in prices or product descriptions,
  • insufficient availability,
  • suspicion of fraud or misuse.

5. DELIVERY, TRANSFER OF RISK

Delivery is made to the delivery address specified by the customer. Delivery times indicated on the web pages or in the order process are non-binding estimates, unless expressly agreed otherwise in writing.

Unless mandatory consumer law provides otherwise, the risk passes to the customer upon handover of the goods to the carrier or shipping service provider. Customers are responsible for any customs duties, import taxes, and fees that may apply in the destination country.

6. CANCELLATION, RETURNS AND REFUNDS

6.1 No statutory right of withdrawal (Switzerland)

Under Swiss law, there is generally no statutory right of withdrawal for online purchases (i.e. no automatic return right simply because you change your mind). Any return options described below are provided by SONOSAX as a contractual policy.

6.2 Order cancellation prior to dispatch

Customers may request cancellation of an order only before dispatch by contacting SONOSAX by e-mail at sonosax@sonosax.ch and providing the order number. If an order has already been dispatched, cancellation is no longer possible and the request will be handled in accordance with Section 6.3 (Voluntary returns), where applicable. Orders for customised / special-order items or services may not be cancellable once processing or performance has started, or may be subject to costs already incurred.

6.3 Voluntary returns (change of mind)

As a goodwill gesture, SONOSAX may accept returns under the following conditions:

  • Return request deadline: within seven (7) days from delivery (as evidenced by carrier tracking or equivalent proof).
  • Condition of goods: unused, unmodified, complete, and returned in original packaging with all accessories and documentation.
  • Exclusions: in particular customised / special-order items, software/licenses, and services; additionally, consumables or sealed items may be excluded once opened where applicable.

Return process:
Before returning any goods, customers must contact SONOSAX at sonosax@sonosax.ch with the order number and a description of the return. SONOSAX will provide return instructions. Returns sent without prior authorisation may be refused or delayed.

Costs and deductions:
Return shipping, insurance, and any customs/handling charges related to the return are borne by the customer. Original shipping charges and payment provider fees (e.g. PayPal fees), if incurred, may be non-refundable to the extent permitted by law.

6.4 Defective or damaged products

If a product arrives damaged or shows a defect, customers must notify SONOSAX without undue delay after receipt or discovery and provide an appropriate description and supporting information (e.g. photos). SONOSAX will assess the claim and provide instructions for return/shipping where required. Warranty rights and remedies are governed by Section 7 (Warranty).

6.5 Refunds

Approved refunds are issued to the original payment method. Refunds are processed after the returned goods have been received and inspected by SONOSAX, or after confirmation of the claim where return is not required. Refunds relate solely to amounts paid for the returned product(s), subject to the deductions described in Section 6.3. Import duties, taxes, brokerage fees or similar charges levied by the destination country are non-refundable by SONOSAX.

7. WARRANTY

SONOSAX warrants all new products against defects in materials and workmanship for a period of two (2) years from the date of the original retail purchase, unless a longer or different period is expressly indicated for specific products.

Damage resulting from the opening of a SONOSAX product or attempted repairs by non-authorized personnel will void the warranty coverage.

The warranty does not cover:

  • normal wear and tear,
  • damage due to incorrect use, improper handling, overloading, modifications, accidents or external influences,
  • damage resulting from non-compliance with the operating instructions.

In the event of a justified warranty claim, SONOSAX may, at its discretion, repair the product, replace it with an equivalent product or refund the purchase price. Further claims, in particular for indirect or consequential damages, are excluded to the extent permitted by law.

8. LIABILITY

To the extent permitted by applicable law, SONOSAX excludes any liability for slight negligence. In particular, SONOSAX is not liable for:

  • indirect or consequential damages,
  • loss of data or loss of profit,
  • damages arising from the use or inability to use the website,
  • errors or interruptions in the availability of the webshop.

This limitation of liability does not apply in cases of gross negligence or unlawful intent, nor in cases of personal injury.

9. PRIVACY POLICY

9.1 Controller and Contact

The online shop www.sonosax.ch is operated by SAS SA (brand: SONOSAX), Chemin de la Naz 38, 1052 Le Mont-sur-Lausanne, Switzerland.

SAS SA is responsible (controller) for the processing of personal data in connection with this website and the webshop.

9.2 Categories of Personal Data

We only process the personal data that you provide to us directly or that arise when you use our webshop, in particular:

  • identification and contact details (such as name, company, postal address, e-mail address, telephone number),
  • order and payment information (such as products ordered, delivery and billing address, payment status; payment card data are processed only by our payment service providers),
  • service and repair information (such as product model, serial numbers, repair history and correspondence),
  • technical data necessary for the secure operation of the website (such as IP address, date and time of access, pages viewed, basic browser and device information).

9.3 Purposes and Legal Bases of Processing

We use this data solely in order to:

  • process and fulfil your orders and payments,
  • provide customer support, repairs and warranty services,
  • communicate with you at your request,
  • ensure the secure and stable operation of our website,
  • comply with our legal obligations under Swiss commercial and tax law,
  • analyse the use of our website and improve our online offering.

Where the processing is necessary for the performance of a contract with you (e.g. for orders, repairs, customer service) or for compliance with legal obligations, the legal basis is contractual necessity or legal obligation.

These recipients only receive the data required for the respective service and are contractually or legally obliged to handle your data confidentially and securely. Apart from these necessary service providers, SONOSAX does not share mailing lists, customer lists or service repair information with any outside entity.

9.5 Data Retention

We retain your order, invoice and warranty data for as long as necessary to fulfil the contract and as required by Swiss law (in particular statutory retention periods, usually up to ten years). Service and repair data are kept as long as needed to manage the product history and customer relationship.

Technical log data are kept only as long as necessary for security and troubleshooting. Analytics data may be stored for periods consistent with the settings of the respective tools and applicable law.

10. USE OF COOKIES AND SIMILAR TECHNOLOGIES

We use cookies and similar technologies on our website to ensure the proper technical functioning of the webshop and to analyse how visitors use our website. Cookies are small data files stored on your device by your browser.

Essential cookies are necessary for the operation of the website (for example, for the shopping cart, login or security) and cannot be disabled in our systems.

12. GOOGLE SERVICES (ADS, TAG MANAGER, CONVERSION TRACKING)

In addition to Google Analytics, our website may use other services provided by Google LLC, such as:

  • Google Tag Manager,
  • other measurement or optimisation services related to our online advertising.

15. APPLICABLE LAW / DISPUTES

This contract is subject to Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of performance and the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions, to the extent permitted by law, is the registered office of SAS SA in Le Mont-sur-Lausanne, Switzerland. Mandatory statutory consumer protection provisions in the customer’s country of residence remain unaffected.
